These Terms of Use ("Terms") govern access to and use of the website operated at istralen.site ("the Site") by Harbour Suite Boutique Lodge (Pty) Ltd (Pty Ltd), trading as Harbour Suite ("Harbour Suite", "we", "us", "our"), and the making of enquiries, reservations and use of guest services offered by Harbour Suite as a boutique hotel establishment. By accessing the Site, submitting the contact form, subscribing to email communications, or otherwise engaging our services, the user ("you", "the user") agrees to be bound by these Terms.

These Terms apply to all interactions conducted through the Site, including but not limited to browsing content describing Harbour Suite's rooms, facilities and services, submitting enquiries via the contact form, subscribing to the email newsletter, and any correspondence resulting from such interactions. These Terms do not constitute a full accommodation or booking agreement; where a reservation is confirmed, separate booking terms and cancellation conditions communicated at the time of confirmation shall apply and shall take precedence over these Terms in the event of conflict.

The Site provides a contact form through which users may submit enquiries regarding accommodation, events or general information. Submission of the form constitutes a request for information or services and does not, in itself, create a binding reservation or contract. Harbour Suite undertakes to respond to enquiries within a reasonable period but does not warrant a specific response time. The information submitted through the form is processed in accordance with our Privacy Policy.

Users may subscribe to receive email communications from Harbour Suite regarding offers, events and news. Subscription is voluntary and requires affirmative action by the user (opt-in). Every marketing email issued will contain a functional mechanism to unsubscribe. Continued receipt of communications after a request to unsubscribe has been actioned should be reported to [email protected] without delay.

All content on the Site, including text, graphics, logos, photographs and the Harbour Suite trading name and mark, is the property of Harbour Suite Boutique Lodge (Pty) Ltd or its licensors and is protected under South African copyright and trade mark law. No content may be reproduced, distributed or otherwise exploited without the prior written consent of Harbour Suite Boutique Lodge (Pty) Ltd, save for use reasonably necessary for personal, non-commercial browsing of the Site.

Nothing in these Terms limits any right or remedy that a consumer may not lawfully waive under the Consumer Protection Act 68 of 2008, to the extent that Act applies to the relationship between the user and Harbour Suite.

The Site may contain links to third-party websites, including booking platforms and payment processors. Harbour Suite does not control and is not responsible for the content, privacy practices or availability of such third-party sites.

The handling of personal information submitted via the contact form or email subscription is governed by our Privacy Policy, which is prepared in accordance with the Protection of Personal Information Act 4 of 2013 (POPIA). By submitting personal information through the Site, the user acknowledges that such processing will occur as described in that policy.

These Terms are governed by the laws of the Republic of South Africa. Any dispute arising from or in connection with these Terms or the use of the Site shall be subject to the non-exclusive jurisdiction of the courts of South Africa having jurisdiction over the area in which Harbour Suite Boutique Lodge (Pty) Ltd is registered.

12. Amendments

Harbour Suite reserves the right to amend these Terms at any time. Amendments take effect upon publication on the Site. Continued use of the Site or continued subscription to email communications following publication constitutes acceptance of the amended Terms.

13. Severability

Should any provision of these Terms be found unlawful, void or unenforceable, that provision shall be severed and the remaining provisions shall continue in full force and effect.
